THE SHORT VERSION

What you're agreeing to, in plain words.

  • Jaybé helps you track and plan money. It isn't a bank, doesn't hold or move money, and doesn't connect to your bank.
  • It gives general information, not financial advice. Decisions stay yours.
  • AI fills in entries for you to check. Nothing is saved until you confirm it.
  • Free stays free. Pro renews through your app store until you cancel there.
  • Your data is yours. You can leave at any time and delete it at jaybe.cloud/delete.
01

About these terms

These Terms of Service (“Terms”) are an agreement between you and The Grower Inc, a company based in the United States (“The Grower”, “we”, “us”), for the Jaybé mobile app, the services it connects to, and this website (together, the “Service”). Our Privacy Policy explains how we handle your personal data and is part of these Terms.

If you don't agree to these Terms, please don't use the Service.

02

Who can use Jaybé

You must be at least 18 years old and able to enter into a binding contract where you live. You may use Jaybé for your own personal or household finances. If you use it on behalf of a business, you confirm you're allowed to accept these Terms for that business.

03

Your account

  • You sign in with a one-time code sent to your email, or with Apple or Google. Keep access to that email or account secure; anyone who can sign in as you can see your data.
  • Give us accurate details and keep them up to date.
  • You're responsible for what happens in your account. Tell us at once at [email protected] if you think someone else has accessed it.
  • We recommend turning on the app lock and keeping your phone's own lock on.
04

What Jaybé is, and isn't

Jaybé is a personal finance tool. It records the entries, accounts, bills, budgets and savings goals you give it and works out figures such as your safe-to-spend amount, totals and reports.

  • Jaybé is not a bank, payment service, lender, broker or investment adviser. It doesn't hold your money, make payments, or move money between accounts. “Auto-save” and similar features record amounts in the app; they don't transfer real money.
  • Jaybé doesn't connect to your bank. Balances and entries come from what you type, say, photograph or import. Your figures are only as accurate and up to date as that information.
  • Exchange rates, safe-to-spend amounts, forecasts and reports are estimates to help you plan. Check important figures against your bank or card statements.
05

Not financial advice

Everything Jaybé shows you, including suggestions, the Grow money coach, net-worth figures and answers from Ask Jaybé, is general information for educational purposes. It isn't financial, investment, tax or legal advice and doesn't take your full circumstances into account. Jaybé never recommends specific securities and never makes trades. For personal advice, speak to a licensed adviser. You're responsible for your own financial decisions.

06

AI features

Some features use artificial intelligence to read what you type or say, receipt photos and statements, and to suggest categories. AI can make mistakes: it may misread an amount, a date, a merchant or a category.

  • Jaybé shows you what it understood before anything is saved. Please check it.
  • Don't rely on AI output as the only record of an important transaction.
  • Content you submit to AI features is processed by our AI provider as described in the Privacy Policy.
07

Plans and subscriptions

Free and Pro

Jaybé has a free plan with limits, and a paid Pro plan with higher or no limits and extra features. The current features and limits of each plan are shown in the app. We may change what each plan includes; if we reduce what a paid plan includes in a significant way, we'll tell you in advance and it won't affect a period you've already paid for.

Buying Pro

  • Pro is sold as an auto-renewing subscription, monthly or yearly, through the Apple App Store or Google Play. The price, in your local currency, is shown in the app and the store before you buy.
  • Payment is taken by the store from the account you use there, and the store's terms apply to your purchase.
  • Your subscription renews automatically at the end of each period, at the then-current price, unless you cancel at least 24 hours before the period ends.
  • Pro belongs to your Jaybé account, not your phone. Sign in with the same account to use it on another device.

Free trials

We may offer a free trial of Pro. The length of the trial is shown in the app before you start it. We'll remind you before it ends. Unless you cancel before the trial ends, the subscription starts and you're charged. If you cancel during a trial, you keep Pro until the trial ends.

Cancelling and refunds

  • Cancel any time in your App Store or Google Play subscription settings (in Jaybé, Profile, then Subscription, takes you there). You keep Pro until the end of the period you've paid for.
  • Refunds are handled by Apple or Google under their policies; we can't issue refunds for store purchases ourselves. Nothing in these Terms limits any refund rights you have under the law where you live.
  • When Pro ends, your data stays. Free plan limits apply again, and nothing you created is deleted.
  • Deleting your Jaybé account or the app does not cancel your subscription. Cancel it in the store.
08

Your content

Your entries, notes, photos, statements, chats and other content you add (“Your Content”) belong to you. You give us a limited, worldwide licence to host, store, process, copy and display Your Content only as needed to run and improve the Service for you, including sending it to the providers listed in our Privacy Policy. This licence ends when Your Content is deleted from our systems.

You confirm you have the right to add Your Content, including any statements or receipts that also contain other people's information, and that doing so doesn't break any law or anyone else's rights.

09

Shared spaces

Where shared spaces are available, the owner of a space decides who can join and what role each member has. Members can see, and editors can change, the content in that space. The space follows the owner's plan. If you leave or are removed from a space, you lose access to its content; entries you added stay in the space. Only invite people you trust.

10

Using Jaybé fairly

Please don't:

  • use the Service for anything unlawful, including fraud or money laundering, or to store content you have no right to;
  • try to access another person's account or data, or probe, scan or test the security of the Service without our written permission;
  • interfere with or overload the Service, or get around plan limits, rate limits or other technical limits;
  • copy, reverse engineer or resell the Service, except where the law allows it despite this restriction;
  • use automated means, or the AI features, to generate content in bulk or for purposes unrelated to your own finances.
11

Our rights

The Service, including the app, its design, the Jaybé name and logo, and everything we create, belongs to The Grower Inc and our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, under these Terms and the rules of the store you got it from. If you send us feedback or ideas, we may use them without any obligation to you.

12

Changes and availability

We're always improving Jaybé, so features may be added, changed or removed. We'll aim to keep the Service available but can't promise it will always be uninterrupted or error-free; we may pause it for maintenance, security or reasons outside our control. Some features may need a recent version of the app.

We may update these Terms. If a change is significant, we'll tell you in the app or by email before it takes effect. If you keep using Jaybé after that, the new Terms apply. If you don't agree, stop using the Service and you can ask us to delete your account.

13

Ending your use

You can stop using Jaybé at any time and delete your account at jaybe.cloud/delete. We delete it, with everything in it, 30 days after your request unless you cancel in that time. You can also write to [email protected] from the address you sign in with.

We may suspend or close your account if you seriously or repeatedly break these Terms, if we must for legal reasons, or if your account has been inactive for a long time. Unless the law or security stops us, we'll tell you first and give you a chance to export your data. Sections that by their nature should continue after your use ends (such as Your Content, Disclaimers, Limits on liability and Governing law) continue to apply.

14

Disclaimers

We work hard to make Jaybé accurate and reliable, but the Service is provided “as is” and “as available”. To the extent the law allows, we make no promises beyond those in these Terms, including that figures, forecasts, categories or AI output will be accurate or complete, or that the Service will meet every need you have. Nothing in these Terms excludes rights you have as a consumer that can't be excluded by law.

15

Limits on liability

To the extent the law allows:

  • We're not liable for indirect or consequential losses, or for loss of profits, savings, opportunity or data, arising from your use of the Service.
  • We're not liable for decisions you make, or payments you make or miss, based on figures or information in Jaybé.
  • Our total liability to you for all claims relating to the Service is limited to the greater of the amount you paid for Jaybé in the 12 months before the claim, and USD 100.

These limits don't apply to liability that can't be limited by law, such as for fraud, or for death or personal injury caused by negligence.

16

Indemnity

If you use the Service in breach of these Terms or the law, and that leads to a claim against The Grower Inc by someone else, you agree to cover the reasonable losses and costs that result, to the extent the law allows.

17

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. If you have a problem, please contact us first; most issues can be solved quickly that way. If we can't resolve it, the state and federal courts located in Delaware will have jurisdiction. If you're a consumer living in another country, you keep the protection of the mandatory laws of your country and may bring a claim in your local courts.

18

App store terms

If you downloaded Jaybé from the Apple App Store:

  • These Terms are between you and The Grower Inc, not Apple. We, not Apple, are responsible for the app and its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
  • Apple is not responsible for any claims relating to the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims, or claims that it infringes someone's intellectual property. We are responsible for handling those claims.
  • You confirm you're not located in a country subject to a U.S. Government embargo or listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you downloaded Jaybé from Google Play, Google Play's terms also apply to your download and purchases. Where these Terms conflict with a store's mandatory terms, the store's terms win for that store.

19

General

  • These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
  • If any part of these Terms can't be enforced, the rest still applies.
  • If we don't enforce a right straight away, we can still enforce it later.
  • You may not transfer your rights under these Terms. We may transfer ours to a company that takes over the Service, and your rights will stay the same.
  • These Terms are written in English. If we provide a translation, the English version applies if they differ.
